1. Purpose of the Code

Csiha Zrt. (registered office: 6724 Szeged, Kossuth L. sgt. 52., Szeged, Hungary, hereinafter referred to as „Csiha Zrt.”, „service provider” or „data controller”) provides services to its customers and partners in the fields of electronics and software development, combined with individual engineering solutions.

As the data controller, Csiha Zrt. processes your personal data (hereinafter referred to as „data subject”) as a data subject and as a user who participates in the data processing in accordance with this privacy policy (hereinafter referred to as „policy”). Csiha Zrt.„s data processing complies with the applicable laws and the provisions of this policy.

Csiha Zrt. processes your personal data only for the purposes and purposes of processing set out in this Policy. The data controller Csiha Zrt. is primarily responsible for data processing towards customers and buyers. The data processor is liable for damages only if it has violated the rules applicable to the data processor or has not followed the lawful instructions of the data controller. The controller shall be solely liable for any errors made by the controller. Csiha Zrt. therefore receives your personal data directly from you.

You may object to the processing

As a data subject, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation. In such a case, the controller, i.e. Csiha Zrt., may no longer process the personal data, unless the controller proves that the processing is justified by compelling legitimate grounds which override the interests, rights and freedoms of the data subject or are related to the establishment, exercise or defence of legal claims.

The customers and partners of Csiha Zrt. who use the services of Csiha Zrt. and purchase products from Csiha Zrt. For the purpose of data processing, the person is referred to as „concerned”, whose personal data are processed. In this processing, the data subjects are typically customers, partners.

Legal basis for processing
The processing of your data is necessary for the performance of the contract. We process your personal data only in connection with the performance of the contract.

We will keep your data until your order has been fulfilled or until the end of the warranty period (6 months) or the guarantee period (1 year) in order to fulfil our warranty and guarantee obligations.

The processing of personal data is lawful under Article 6(1)(b) of the GDPR if the processing is necessary for the performance of the contract, to which the data subject is a party or is necessary for taking steps at the request of the data subject prior to the conclusion of the contract; and pursuant to Section 13/A of Act CVIII of 2001 on certain issues of electronic commerce services and information society services (Act on electronic commerce), the controller is entitled to process personal data in connection with the processing. The legal basis for this is Article 6 (1) f) of the GDPR necessary for the purposes of the legitimate interests pursued by the controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child.

The personal data of the customer as defined above may be accessed by Csiha Zrt. and its employees who carry out the data management.

 

Where we store the customer's (data subject's) personal data
Csiha Zrt. stores the personal data of its customers on its own servers, therefore it does not use external hosting providers.

 

Is the customer (data subject) obliged to provide personal data
You are not obliged to provide your personal data. However, if you do not provide this personal information, you will not be able to use the services of Csiha Zrt. and you will not be able to purchase Csiha Zrt. products. Therefore, providing your personal data above is in our mutual interest.

 

Data processing and storage period
We will process your data for the duration of the contract. After the termination of the contract, Csiha Zrt. may process your personal data necessary for the enforcement of its legitimate interests. On this basis, your personal data may be processed for a general limitation period of 5 years for the purpose of pursuing your legitimate interests in relation to your orders.

 

Transfer of personal data to a third country
Your personal data will not be transferred to third countries. By third country we mean countries that are not members of the European Union.

 

Automated decision-making and profiling in relation to data management
In connection with the above data processing, profiling is carried out through our company. Our company does not carry out profiling. A „profiling” any form of automated processing of personal data whereby personal data are used to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict characteristics associated with the performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements of that natural person.

The purpose of profiling is to provide you with services that are more interesting and relevant to you, or to provide you with a website that is better suited to your habits. Profiling only covers your habits and preferences. Profiling does not impose any adverse consequences or restrictions of any kind on you.

Csiha Zrt. will fulfil your order by delivering the goods to you via its home delivery service. In connection with the delivery, Csiha Zrt. processes the delivery data of the customer. In connection with the invoicing, Csiha Zrt. handles the billing data of the customers. The purpose of this data processing is to enable Csiha Zrt. to comply with its legal obligation to issue accounting documents for economic events.

Pursuant to Article 169 (1) - (2) of Act C of 2000 on Accounting, the retention period of the invoice and the data required for its issue is 8 years.

Is the applicant (data subject) obliged to provide personal data
You are not obliged to provide your personal data. However, if you do not provide such personal data, Csiha Zrt. will not be able to process your application, CV or job application and will not be able to establish an employment relationship with you. It is therefore in our mutual interest that you provide us with the above personal data.

Data processing and storage period
If the application, CV, application for recruitment is evaluated or withdrawn, Csiha Zrt. will delete your personal data within 1 month after the evaluation and withdrawal of the application, CV, application. If you give your consent, we may process your application until your consent is withdrawn.

Csiha Zrt. recruitment candidates are those who wish to conclude an employment contract with Csiha Zrt. For the purposes of data processing, a person is referred to as “for stakeholders”, whose personal data are processed. In this processing, the data subjects are typically applicants for recruitment.

The following personal data is processed by Csiha Zrt. in order to fulfill orders and provide services:
Identifying information: the name of the candidate, the information given in his/her CV
Contact details: applicant's telephone number, e-mail address

Furthermore, any data necessary for the performance of trade, the sale of goods and the provision of services.

Legal basis for processing

The processing of your data is necessary for the establishment of an employment contract. The processing of personal data is lawful under Article 6 (1) b) of the GDPR if the processing is necessary for the performance of a contract to which the data subject is a party or is necessary for taking steps at the request of the data subject prior to entering into the contract; and under Article 13/A of Act CVIII of 2001 on certain aspects of electronic commerce services and information society services (Act on the processing of personal data), the controller is entitled to process your personal data in connection with the processing.

In addition, processing is lawful pursuant to GDPR Preamble (44) if it is necessary in the context of a contract or the intention to conclude a contract.

As a data subject whose personal data is processed, you have the following rights in relation to the processing. Please note that you may exercise the rights set out below primarily against the controller. You can exercise your rights in Lenti against Csiha Zrt.

Right to information

 

General rules on the information of the data subject and the right to information
Before the processing starts, the data subject must be informed in detail by the controller at the latest when the personal data of the data subject are obtained. In relation to the processing, the information contained in this privacy notice.

The controller is responsible for providing prior information. The data controller in relation to the processing of your data is Csiha Zrt.

In addition to the above prior information, you may request information from the controller at any stage of the processing, as follows. In this case, the controller shall provide the information without undue delay and at the latest within 25 days. The 25-day period may be extended by a maximum of 2 months only in justified cases.

The controller may refuse to provide the information only if it proves that the data subject cannot be identified.

If the controller does not take action, i.e. does not comply with the obligation to provide information, it must inform the data subject within 25 days of the failure to take action, the reasons for the failure to take action and the data subject's right to lodge a complaint or to bring a case before a court. Details of how to lodge a complaint or seek judicial redress are set out below.

The information and action shall be provided by the controller to the data subject free of charge. However, the controller may exceptionally charge a reasonable fee or refuse to provide the information and take action where the data subject's request is manifestly unfounded, repetitive or excessive.

 

Right of access of the data subject
The data subject shall have the right to obtain from the controller feedback as to whether or not his or her personal data are being processed and, if such processing is taking place, the right to access the personal data and the following information:

On the basis of the right of access, the data subject shall be informed, upon request, of the following information: a) the purposes of the processing; b) the categories of personal data concerned; c) the recipients or categories of recipients to whom or which the personal data have been or will be disclosed, including in particular recipients in third countries, or. (e) the right of the data subject to obtain from the controller the rectification, erasure or restriction of the processing of personal data concerning him or her and to object to the processing of such personal data; (f) the right to lodge a complaint with the supervisory authority (NAIH); (h) the existence or absence of automated decision-making, including profiling, and, at least in those cases, the logic used and clear information on the significance of such processing and its likely consequences for the data subject.

The data controller shall provide the data subject with a copy of the personal data processed. For additional copies requested by the data subject, the controller may charge a reasonable fee based on administrative costs.

Where the data subject has made the request by electronic means, the information shall be provided in a commonly used electronic format, unless the data subject requests otherwise.

Right to rectification
The data subject shall have the right to obtain from the controller, upon his or her request and without undue delay, the rectification of inaccurate personal data relating to him or her. Having regard to the purposes of the processing, the data subject shall have the right to obtain the rectification of incomplete personal data, including by means of a supplementary declaration.

Right to erasure, „right to be forgotten”
As a data subject, you have the right to obtain from the controller the erasure of personal data relating to you without undue delay, and the controller has the obligation to erase personal data relating to you without undue delay, if one of the following grounds applies: 

(a) the personal data are no longer necessary for the purposes for which they were collected or otherwise processed; 

(b) where the processing is based on the data subject's consent (e.g. sending a newsletter) and the data subject withdraws his or her consent to the processing and there is no other legal basis for the processing; 

(c) the data subject objects to the processing and there are no overriding legitimate grounds for the processing; 

d) the personal data have been unlawfully processed;

(e) the personal data must be erased in order to comply with a legal obligation under Union or Member State law to which the controller is subject; 

f) the personal data were collected in connection with the provision of information society services.

Where the controller has disclosed the personal data and is required to erase them pursuant to paragraph 1, it shall take reasonable steps, including technical measures, taking into account the available technology and the cost of implementation, to inform the controllers that process the data that the data subject has requested the deletion of the links to or copies of the personal data in question.

The controller shall not be obliged to comply with a request for erasure in the above cases where the processing is necessary: a) for the exercise of the right to freedom of expression and information; b) to comply with an obligation under Union or Member State law to which the controller is subject to which the processing of personal data is subject; or c) to comply with a request for erasure in the following cases. (c) on grounds of public interest in the sphere of public health; (d) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, where the right of erasure would be likely to render impossible or seriously impair such processing; or (e) for the establishment, exercise or defence of legal claims.

 

Right to restriction of processing
The data subject shall have the right to obtain, at his or her request, the restriction of processing by the controller if one of the following conditions is met: (a) the data subject contests the accuracy of the personal data, in which case the restriction shall be for a period of time which allows the controller to verify the accuracy of the personal data; (b) the processing is unlawful and the data subject opposes the erasure of the data and requests instead that the use of the data be restricted; (c) the controller no longer needs the personal data for the purposes of the processing but the data subject requires them for the establishment, exercise or defence of legal claims; or (d) the data subject has objected to the processing, in which case the restriction shall apply for a period of time until it is established whether the legitimate grounds of the controller override the legitimate grounds of the data subject.

Where processing is restricted on the basis of the above, such personal data may be processed, except for storage, only with the consent of the data subject or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or of an important public interest of the Union or of a Member State.

The data controller shall inform the data subject whose request for restriction of processing has been made on the basis of the above in advance of the lifting of the restriction.

Obligation to notify the rectification or erasure of personal data or the restriction of processing

The controller shall inform any recipient to whom or with whom the personal data have been disclosed of the rectification, erasure or restriction of processing, unless this proves impossible or involves a disproportionate effort.

The controller shall inform the data subject of these recipients at his or her request.

The right to data portability
The data subject shall have the right to receive personal data concerning him or her which he or she has provided to a controller in a structured, commonly used, machine-readable format and the right to transmit those data to another controller without hindrance from the controller to which he or she has provided the personal data, where: a) the processing is based on the data subject's consent (e.g. sending a newsletter) or on the performance of a contractual obligation between the parties; and b) the processing is carried out by automated means.

In exercising the right to data portability as set out above, the data subject shall have the right to request, where technically feasible, the direct transfer of personal data between controllers.

The exercise of the right to data portability must not prejudice the right to erasure. The right to data portability must not adversely affect the rights and freedoms of others.

Right to object
As the data subject, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation. In such a case, the controller may no longer process the personal data unless the controller can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

Where personal data are processed for direct marketing purposes (e.g. sending marketing mail to customers), the data subject has the right to object at any time to the processing of personal data concerning him or her for such purposes, including profiling, where it is related to direct marketing. If the data subject objects to the processing of personal data for direct marketing purposes, the personal data may no longer be processed for those purposes.

Right to withdraw consent
Where the legal basis for processing is the data subject's consent (e.g. sending a newsletter for marketing purposes), the data subject has the right to withdraw his or her consent at any time. However, the withdrawal of consent does not render the processing prior to the withdrawal unlawful.

Storage of personal data and security of processing
Csiha Zrt.'s IT infrastructure, storage and other data storage facilities are located at its headquarters and premises.

The IT tools and solutions used for data processing, in particular security systems, are selected and used in such a way that the personal data processed are accessible to those authorised to access them, their authenticity and authentication are ensured, their integrity is verifiable and they are protected against unauthorised access.

We will take appropriate measures to protect your personal data, in particular against unauthorised access, alteration, data breach, data theft, data leakage, disclosure, transmission, alteration, deletion or destruction, accidental destruction or damage and inaccessibility due to changes in the technology used.

In order to protect the data files managed in its records, Csiha Zrt. ensures that the stored data cannot be directly linked or attributed to the data subject, except in the case of legal authorisation.

In view of the current state of the art, we ensure the security and protection of our data processing by taking technical, organisational and organisational measures that provide an adequate level of protection for your personal data.

The IT system and network of Csiha Zrt. and its partners are protected against dangerous human (e.g. fraud, espionage, sabotage, vandalism, computer viruses, computer intrusions, etc.), natural (e.g. fire and flood) or other (e.g. service outages, etc.) harmful intrusions. Csiha Zrt. ensures the security of its data through server and software level protection procedures and services.

Csiha Zrt. protects the processing of personal data so that only those who are entitled to access it have access to it (confidentiality), the accuracy and completeness of personal data and the method of processing (integrity), ensures that when authorized users need the personal data, they can actually access the data and that they are available (availability).

We inform data subjects and our partners that personal data is partly transmitted to Csiha Zrt. via the internet. Regardless of the protocol used (e-mail, web, ftp, etc.), the security of data and electronic messages transmitted over the Internet is vulnerable to network threats that could be used to commit fraudulent activity, to dispute a contract, or to disclose or modify information. To eliminate such threats, Csiha Zrt. will take all reasonable security measures.

The data breach and its handling
Based on the European Data Protection Regulation (GDRP) Data protection incident a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed. A data breach is therefore any event or situation where your personal data could fall into unauthorised hands.

In the event of a data breach, we will notify the incident to the competent supervisory authority without undue delay, but no later than 72 hours after the data breach has come to our attention, or inform you as the data subject if the data breach is likely to result in a risk to the rights and freedoms of natural persons.

Right to complain
As a data subject, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the law. The competent supervisory authority in Hungary is the National Authority for Data Protection and Freedom of Information (NAIH).

Exercising the right to complain does not exclude the possibility for you, as the data subject, to seek other administrative or judicial remedies if you consider that your personal data are being processed in a way that is unlawful. Therefore, even if you exercise your right to complain, you may also exercise your right to seek administrative or judicial redress at the same time.

Right to judicial remedy against a decision by the NAIH or another supervisory authority
If you have applied to the supervisory authority (NAIH) in relation to your data processing and the authority has taken a decision in your case, you, as the data subject, have the right to seek judicial remedy against this decision, i.e. to challenge the decision in court. You also have the right to judicial remedy if the competent supervisory authority (NAIH) does not deal with the complaint or does not inform the data subject of the procedural developments or the outcome of the complaint within three months.

Proceedings against the supervisory authority (NAIH) must be brought before the courts of the Member State where the supervisory authority is established.

Right to judicial remedy against the controller or processor
As the data subject, you have the right to judicial remedy if you consider that your rights in relation to the processing of your personal data have been infringed as a result of the unlawful processing of your personal data. The exercise of the right to judicial remedy does not exclude the possibility for you, as the data subject, to seek other administrative or judicial remedies or to exercise your right to lodge a complaint if you consider that your personal data are being processed unlawfully.

Proceedings against the controller or processor shall be brought before the courts of the Member State in which the controller or processor is established. In the case of Csiha Zrt., the courts of the place of establishment are the courts of Hungary. While the competent court according to the place of establishment of Csiha Zrt. is the Szeged District Court or, in case of special jurisdiction, the Szeged Regional Court.

A judicial remedy may also be brought before the courts of the Member State in which the data subject has his or her habitual residence, unless the controller or processor is a public authority of a Member State acting in its exercise of official authority.

Liability and damages
In other words, how is the controller or processor liable to the data subject in the event of damage?

If the inappropriate processing has caused damage to you as the data subject, the controller is liable for compensation for the damage. Damage can be said to have occurred if the processing was unlawful or in breach of contract and the data subject suffered financial loss as a result. In the case of unlawful processing, the data subject may also claim damages.

You may pursue your claim for damages or compensation primarily against the controller. The processor is only liable for damages if it has only breached the rules applicable to it or has not followed the lawful instructions of the controller. In other words, the processor is not liable for errors made by the controller.

We would like to inform you that Csiha Zrt. (Registered office: 6724 Szeged, Kossuth Lajos sgt. 52.; hereinafter referred to as „the Company”) operates an electronic surveillance system (CCTV system) at the following premises:

The electronic monitoring system is operational 24 hours a day, 7 days a week. The rules of recording, use and preservation of images and audio recordings are governed by the provisions of Act CXXXIII of 2005 on the Rules of Personal and Property Protection and Private Investigation (Act on the Rules of Private Investigation), Act CXII of 2011 on the Right to Information Self-Determination and Freedom of Information (Act on the Right to Information Self-Determination and Freedom of Information). (Info tv.), and the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Regulation (EC) No 95/46/EC shall apply. 

Legal basis for processing: voluntary consent of the data subject. If you enter the monitored area despite this information, you will be deemed to have given your consent to the taking of the photograph. Please do not enter if you do not wish to give your consent. 

Purpose of the processing: preventing, detecting, catching offenders in the act and proving offences and accidents in order to protect human life, limb and property. Scope of the data processed: facial image and other personal data of the data subject as shown in the photographs. 

The operator of the electronic surveillance system: the Company. 

Duration of data storage: Recorded footage will be retained until the storage server is full. This is necessary to ensure adequate protection of persons and property and to enable the Company to respond to various requests from public authorities. The use of recorded images and other personal data as evidence in judicial or other official proceedings is considered as use.

Persons entitled to access the data: the Company's Chief Executive Officer, Chief Development Officer, Chief Operating Officer and Chief Privacy Officer. 

The location of the data storage: the recordings are stored in the server room of the Company at 6724 Szeged, Kossuth Lajos sgt. 52. In order to ensure the secure handling of personal data, the data stored on the server is protected by a personal username and password, which allows to identify who has access to the data and when.

Persons entitled to access the data: the Company's Chief Executive Officer, Chief Development Officer, Chief Operating Officer and Chief Privacy Officer.

The recordings are reviewed at the following regular intervals: the recordings may be viewed occasionally by authorised persons, solely for the purpose of proving the existence of offences against human life, limb or property and identifying the perpetrator, or for the purpose of investigating other incidents or accidents involving life or limb. Data may only be transferred to the authorities or courts in the event of ongoing proceedings in respect of unlawful conduct or misconduct. The data transmitted may include recordings made by the camera system containing relevant information and the names of any persons who may be included in the recording.

Please be informed that data subjects whose rights or legitimate interests are affected by the recording of images may request a copy of the recordings made of them by the electronic surveillance system and may request the deletion of the recordings in accordance with the relevant legal provisions. In addition, anyone whose right or legitimate interest is affected by the recording of an image recording may, within 3 working days of the recording of the image recording, request that the data not be destroyed or deleted by the Company by providing evidence of his or her right or legitimate interest.

You have the right to request the Company to access, rectify, erase or restrict the processing of personal data concerning you and to object to the processing of such personal data, as well as the right to data portability.

You have the right to withdraw your consent at any time, without prejudice to the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.

Please note that in the event of a breach of your rights, you may take legal action in accordance with the provisions of the applicable legislation, and you may also file a complaint with the National Authority for Data Protection and Freedom of Information to initiate an investigation on the grounds that your personal data have been processed in violation of your rights or that there is an imminent threat of such violation.

Csiha Innovation and Technology Ltd. operates an internal abuse reporting system for the detection, prevention and elimination of violations in accordance with the provisions of Act XXV of 2023 on Complaints, Public Interest Reports and Rules for Reporting Abuses.

The internal abuse reporting system allows you to report information on alleged or suspected illegal acts or omissions or other abuses of EU law. The reporting system does not cover the handling of other complaints.

The internal whistleblowing system is operated by the Administration area within Csiha Innovation and Technology Ltd. 

The notifier may make the notification to the territory in writing or orally. An oral notification may be made in person. 

In the case of a personal report, the oral report will be recorded in writing, after informing the notifying party about the processing of personal data, and a copy of the recorded report will be provided to the notifying party, with the possibility to verify, correct and sign it. A complete and accurate record of the oral notification shall be drawn up when the written record is made. 

The written notification can be sent by post (Postal address: 6724 Szeged, Kossuth l. sgt. 52.) or by e-mail (E-mail address: eszrevetel@csihazrt.hu). It is important to include your name, contact details, your relationship with the undertaking and a description of the infringement. All notifications, including the identity of the notifier, will be treated in strict confidence at all stages of the investigation. 

Please note that the examination of a notification may be waived if the notification is not identified or has not been made by a person entitled to do so; if the notification has the same content as the notifier's previous notification; and if the harm to the public interest or overriding private interest would be disproportionate to the restriction of the rights of the natural or legal person (hereinafter together referred to as the "person concerned") resulting from the examination of the notification.

Finally, please note the consequences of reporting in bad faith. This means that if it becomes apparent that the whistleblower has communicated false data or information in bad faith and 

(a) where there are indications that a criminal offence or irregularity has been committed, the personal data must be handed over to the authority or person responsible for the procedure,
